Terms of sale and use

This website is operated by Jakub Ivančo, trading as Darksteady, a sole trader registered in Czech Republic.

References to "we", "us" and "Darksteady" below mean that business. References to "you" mean the person or organisation buying or using an asset.

Purchases are not processed by us directly. Lemon Squeezy, LLC acts as merchant of record for every order placed through this store. This means your contract of sale is with Lemon Squeezy, LLC: they take the payment, charge and remit any sales tax or VAT due in your country, issue your invoice, and are the party named on your card or bank statement.

Darksteady is the author and licensor of the asset. The licence you receive is granted by us; the sale that delivers it is made by Lemon Squeezy, LLC.

Lemon Squeezy, LLC has its own buyer terms and privacy policy, which apply to the payment itself alongside these terms. Where the two conflict on a matter of the transaction — payment, tax, invoicing, chargebacks — theirs govern.

These terms, the licence and the refunds policy govern everything else: what the asset is, what you may do with it, and what we will do if something is wrong with it.

Each purchase is a licence to use one or more digital 3D assets, delivered as a download. Nothing physical is shipped.

The formats, texture resolution and file size stated on a product page describe that specific asset. Where an asset offers fewer formats than the store generally advertises, the product page is authoritative and the general statement is not.

Delivery is by a download link sent to the email address given at checkout, available immediately after payment is confirmed. Links remain valid for at least 30 days. If a link expires or fails before you have retrieved your files, contact us and it will be reissued.

You are responsible for giving a working email address. We cannot deliver to an address that does not accept our mail, and a mistyped address is not grounds for a second charge being refunded automatically — though in practice we will simply resend to the corrected address.

Every asset is supplied under the Darksteady licence, which grants royalty-free, perpetual, worldwide commercial use, and prohibits redistributing the asset itself. The full text forms part of these terms and takes precedence over any summary of it printed elsewhere on the site.

Assets are sold at two price tiers. Both grant identical rights. The Professional tier applies where your commercial activity grossed $100,000 or more in the preceding twelve months, and is self-declared at checkout. Selecting the wrong tier does not invalidate the licence, but we may ask for the difference to be settled.

All prices are shown in US dollars and exclude any VAT or sales tax due in your country. Tax, where applicable, is calculated and added at checkout by the merchant of record, based on the location you provide.

We may change prices at any time. A change never affects an order already placed, and never affects a licence already granted.

Where a discount, pack rate or promotional price is shown, it applies only to the order in which it appears. Discounts do not stack unless the checkout applies them together.

One asset is offered free each month. It carries exactly the same licence as a paid asset — full commercial use, in perpetuity — and is yours to keep once claimed, including after the month ends.

Claiming it requires an email address and confirmation of that address. What we do with it is set out in the privacy policy.

We may change which asset is free, and may stop offering a free asset at all. Neither affects anything already claimed.

Digital content delivered immediately is subject to a specific rule under EU consumer law: the statutory 14-day right of withdrawal is lost once delivery begins, provided you have given prior express consent and acknowledged that loss. You are asked to give that consent at checkout.

This does not remove your rights where an asset is faulty, materially different from its description, or was never delivered. The refunds policy sets out what happens in each case, and it is more generous than the law requires.

You may browse, download the free asset, and use everything published here for the purpose of deciding what to buy.

• Do not attempt to obtain paid files without paying for them, including by guessing, sharing or reusing download links.
• Do not scrape, mirror or republish the catalogue, the preview renders or the 3D preview models. Preview models are deliberately reduced and are not licensed for use in any project.
• Do not attempt to disrupt the site, its email systems or its hosting.

We may withdraw access from anyone who does these things, and may decline to sell to them.

We aim to keep the store and its downloads available continuously, but this is a small operation and we do not promise uptime. Maintenance, hosting failures and provider outages happen.

If the store closes permanently, licences already granted continue unaffected, and we will give reasonable notice so that files can be retrieved.

Assets are supplied as they are. We warrant that we own or control the rights we are granting, and that the files are what the product page describes. We do not warrant that an asset is fit for a particular project — that is a judgement only you can make, which is why every product page carries renders, specifications and a 3D preview where one exists.

To the extent the law allows, our total liability arising from any purchase is limited to the amount paid for it. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited — including your statutory rights as a consumer, which are not affected by anything here.

These terms are governed by the law of Czech Republic. If you are a consumer resident in the EU, you also keep the protection of the mandatory consumer law of your own country, and may bring proceedings there.

The Czech Trade Inspection Authority (Česká obchodní inspekce, coi.cz) is the competent out-of-court dispute resolution body for consumer disputes with us. The European Commission also operates an online dispute resolution platform.

Disputes about payment, tax or invoicing are matters for Lemon Squeezy, LLC as merchant of record and follow their process.

We may revise these terms. A revision applies only from the date it is published, and never retroactively: the terms in force when you bought continue to govern that purchase.
