Right of withdrawal
The statutory 14-day right, in plain words: when you have it, when you have given it up, and exactly how to use it if you want to.
1. The right, in one paragraph
If you are a consumer — buying for yourself rather than for a business — you have the right to withdraw from a contract concluded at a distance within 14 days, without giving any reason and without penalty. The period runs from the day the contract is concluded, which for digital content is the day you buy.
You do not have to explain yourself, and we may not ask you to.
2. When the right does not apply, and why you are asked about it
There is one exception that matters here, and it is the reason this store can operate at all: the right is lost for digital content that is not supplied on a physical medium, where delivery has begun with your prior express consent and you acknowledged that this consent ends the right.
That is what the tick box at checkout is. It is not buried, it is not pre-ticked, and until it is ticked the payment button does not work — the server refuses to create a checkout without it, so it cannot be removed by accident.
- Tick it: your files are delivered immediately and the 14-day right ends at that moment.
- Do not tick it: the order cannot be placed. This store does not offer a delayed delivery, because an immediate download is the only thing it sells.
The point is that the choice is made knowingly, before paying, rather than for you afterwards.
Your delivery email repeats both the consent and the loss of the right, and carries the terms and the licence as attachments, so you have a record of what you agreed to on a durable medium rather than only on a page you have navigated away from.
3. Where the right is still live
- You paid and delivery never began — no download link reached you. The right is lost only when delivery starts, so until then the full 14 days apply.
- You are a business rather than a consumer. Then this right never applied to you in the first place — but the licence and the terms still do.
And separately from all of it: if an asset is faulty, incomplete or not what the product page described, you have statutory rights that no tick box can waive. Those are set out in the terms and on the refunds page, and they last far longer than 14 days.
4. How to withdraw
Send us an unambiguous statement that you are withdrawing, to hello@darksteady.com. Any clear wording works — you may use the model form below, but you are not obliged to.
To meet the deadline it is enough that you send the statement before the 14 days expire. It does not have to have been read, or accepted, or processed by then.
We will confirm receipt without delay, and refund every payment received from you, using the same means of payment you used, without undue delay and in any event within 14 days of being told. You are charged no fee for the refund.
Because the merchant of record takes the payment, the money is returned by them to the original method. How long your bank then takes is between you and your bank, typically 5–10 working days.
5. Model withdrawal form
Copy this, fill it in and email it. It follows the model form in Government Regulation No. 363/2013 Coll. and Annex I(B) of Directive 2011/83/EU. Completing and sending it is optional.
